HEE responds to ICO recommendations

HEE welcomes the judgment from the Information Commissioner which makes clear that the sending of information to doctors in training about the new contract offer was "...likely to be lawful, proportionate and reasonable given HEE's broad statutory remit...." The ICO goes on to say because of this broad remit "... it is reasonable that information about contracts and work conditions is connected with and impacts upon the education and training of junior doctors and workforce planning.... therefore our view is that dissemination of the information is likely to be lawful."

In line with the ICO recommendation we will make all of this more explicit to those whose information we hold for communication reasons. We are currently changing our privacy notice but welcome the ICO's view that HEE could not have ".... anticipated that this would be something that needed to be explicitly explained to trainees" when HEE's initial privacy notice was drawn up.

We take our use of personal information very seriously and we will move swiftly to ensure the issues raised are addressed as quickly as possible.
